Arouca, a Portuguese municipality, is in focus due to a trial related to the illegal felling of over 60 protected trees in Arouca. E-Redes, the company operating the electricity distribution network in Portugal continental, is accused of environmental damage. The company was accused of ordering the felling of 63 trees, which were located under a power transmission and distribution network, despite only having authorization from the Institute for Conservation of Nature and Forests (ICNF) for the felling of eight adult trees. The Public Ministry (MP) opened an investigation against E-Redes, the company that was awarded the tree-cutting contract and its legal representative, but decided to archive the case, alleging that there was sufficient evidence that the crime of environmental damage had not been committed. However, the landowner requested the opening of the instruction, which ended with the pronouncement of the accused for the practice of co-authorship of a crime of environmental damage. Unhappy with the decision, E-Redes appealed to the Court of Appeal of Porto, which confirmed the decision of the Santa Maria da Feira Instruction Court. The pronouncement refers that the accused felled, in addition to other species of trees, the 63 trees existing in the land in question without the necessary legal authorization issued by the ICNF for the purpose, at least for 55 of them, despite being aware and that such conduct was prohibited and punished by law and wanted to do so. The document also refers to the lack of cooperation of the company, which throughout the process has made it difficult to investigate, either by not responding to the information requested, or by invoking successive excuses for not presenting the authorizations, thus managing to avoid its timely constitution as an accused.
